By accessing or using Eaploud (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Eaploud.

2. Description of Service

Eaploud is a social media analytics platform that provides creators with insights and performance data for their TikTok and YouTube accounts. The Service allows you to connect your social media accounts and view analytics dashboards including engagement metrics, video performance, and audience data.

3. User Accounts & Authentication

To use Eaploud, you must connect at least one social media account (TikTok or YouTube) through OAuth authentication. You are responsible for maintaining the security of your connected accounts and for all activity that occurs under your session. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights.
• Attempt to gain unauthorized access to the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Scrape, harvest, or collect data from the Service through automated means beyond normal API usage.
• Use the Service to engage in any fraudulent, deceptive, or misleading activity.
• Reverse engineer, decompile, or disassemble any part of the Service.

5. Intellectual Property

The Service, including its design, features, code, and content, is owned by Eaploud and is protected by intellectual property laws. You retain ownership of your social media content and data. By using the Service, you grant us a limited license to access and process your data solely for the purpose of providing analytics services to you.

6. Data Usage & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in our Privacy Policy.

7. Third-Party Services

The Service integrates with third-party platforms, including TikTok and YouTube (Google), through their respective APIs. Your use of these integrations is subject to the terms and policies of those third-party platforms. We are not responsible for the availability, accuracy, or practices of third-party services. Changes to third-party API terms or availability may affect the functionality of Eaploud.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE ANALYTICS DATA WILL BE COMPLETELY ACCURATE OR RELIABLE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EAPLOUD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Indemnification

You agree to indemnify, defend, and hold harmless Eaploud and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may discontinue your use of the Service at any time by disconnecting your social media accounts. Upon termination, your right to use the Service will immediately cease, and we may delete your data in accordance with our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Eaploud operates, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the competent courts of that jurisdiction.

13. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will notify you of material changes by posting the updated Terms on this page with a revised date. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.
